Stanislav Shmulevich of Brooklyn was arrested on charges of criminal mischief and aggravated harassment, both hate crimes, police said. It was unclear if he was a student at the school. A message left at the Shmulevich home was not immediately returned.
The Islamic holy book was found in a toilet at Pace's lower Manhattan campus by a teacher on Oct. 13. A student discovered another book in a toilet on Nov. 21, police said.
Shmulevich actions were in poor taste. However, I do not believe they constitute a hate crime. Shmulevich owned the Koran, he is free to treat his property in any way he pleases, including making a public statement about Islam. His actions are covered by the 1st Amendment. This is a free speech issue.
Shmulevich's arrest is clearly another act of political correctness aimed at appeasing Islamic activist. If Shmulevich had thrown a Koran in in the trash, Muslims would argue he committed a hate crime. If he had burned a Koran, pissed on a Koran, or feed it to pigs, Muslims would claim a hate crime. Yet, we live in America - his actions are protected by the constitution.
