Pastor Enoch Jermaine Hill’s conviction overturned

Pastor Hill was sentenced to five years in prison in May of 2007. The Maryland Court of Appeals found that interrogating officers violated pastor Hill’s rights by creating an improper inducement (pdf).

The statement to a suspect by an interrogating officer that the victim did not want the suspect to get into trouble, but instead wanted an apology for what happened, is an improper inducement. Any subsequent statement made by the suspect in reliance on that inducement is deemed involuntary and inadmissible as a matter of Maryland non-constitutional common law.

Pastor Enoch Jermaine Hill is free pending a decision by the prosecutor to retry the case. Since the dissenting opinion was clear regarding the admissibility of Hill’s other incriminating comments, let’s hope the re-file the case.

The verbal guile exhibited by Detective McLaughlin in his thirty-minute questioning of Hill, which followed Hill’s recorded telephone conversation with the victim, did not cross the line into the prohibited territory of promises, threats, or inducements, such as would render Hill’s interview statements involuntary under Maryland common law principles. The suppression judge and the Court of Special Appeals got it right.

Hill admitted to apologizing to the victim while on the stand in his trail. Let’s hope the prosecutor has the guts to retry the case. The transcript of the telephone call between the victim and Pastor hill should be enough evidence to put him away.

Finally these corrupt cops are being called out! They coerce people into giving false confessions all the time. Maybe your dumb ass will get coerced and you will walk in Mr. Hill's shoes one day.

It's doubtful, since I don't molest children.
It sounds like something from the Wire - the police getting the suspect to write an apology.

Former Essex minister pleads guilty in child sex case

First conviction was overturned on appeal

October 19, 2011|By Andrea F. Siegel, The Baltimore Sun

A former minister at an Essex church whose conviction for sexually abusing a child was overturned pleaded guilty Wednesday to a fourth-degree sex offense, according to Anne Arundel County prosecutors.

The conviction means that Enoch Jermaine Hill, 34, will be included on the state's sex offender registry. Hill, who had been an associate minister at the House of God, was accused by a boy who said he was 10 years old when Hill molested him in 2004 and 2005 at his home in Odenton.

Before the start of the second day of his new trial yesterday, an Odenton minister accused of molesting a 9-year-old boy opted not to leave his fate in the hands of a jury.

Enoch Jermaine Hill, 34, entered an Alford plea to fourth-degree sex offense, putting a stop to the trial in Circuit Court in Annapolis. In return, prosecutors dropped the previous, more serious charges Hill was convicted of, including sexual abuse of a minor, second-degree sex offense and unnatural or perverted practice.

He was sentenced to the maximum of one year in jail, but received credit for the three-plus years he served in prison

If you were in court and read the transcripts it was an ALFORD PLEA! So what the hell does that mean since you so smart Ms Preacher Lady? It means you are not admitting guilt but believe the State has enough evidence for a conviction. What's the evidence...the lying ass accuser and his mother!!! The jury will believe a lying child over an innocent man everytime!!! Duh!!! Shoot...I woulda took the deal too!!! LOL!!! I know Enoch and he is doing VERY VERY well now in the church and his business...much better than the Fowlers or Davis!!!!
The signed confession made it easy enough to to find him guilty at his first trial.
However,
As a member of that Jury, we would have found him guilty without it. There was other convincing evidence.
Specifically, "Hill admitted to apologizing to the victim while on the stand in his trail. "...because there is clear, admissible evidence that this happened.

Apparently a second Jury was headed that way too, so he took a plea. This molester needs to stay on the offenders list. I wouldn't leave him alone with my kids.
